These Terms of Sale and Business Conditions ("Terms") govern all transactions, purchases, and contract manufacturing agreements conducted with KbyV - It's U, For U ("Company", "We", "Us"), operating at 704, Wagle Estate, Shreenagar, Thane (W), MH, India - 400604.
Governing Law & Jurisdiction: All agreements, retail orders, and contract manufacturing projects are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Thane/Mumbai, Maharashtra, India.
Age Eligibility: By placing an order for retail products or entering into a B2B contract manufacturing agreement, you represent and warrant that you are at least 18 years of age and legally competent to enter into binding contracts under the Indian Contract Act, 1872.
KbyV crafts high-concentration Extrait de Parfums using natural botanical extracts, aged essential oils, and aromatic resins. Due to the organic nature of raw heartwood and floral harvests, minor batch-to-batch variations in liquid color or top-note nuance may occur. Scent perception is subjective; longevity depends on skin chemistry, application technique, and ambient climate.
All prices listed on our digital channels are displayed in Indian Rupees (INR ₹). Retail prices shown on our website are inclusive of applicable Goods and Services Tax (GST) as mandated by the Government of India, unless explicitly stated otherwise during checkout.
We accept online payments via Unified Payments Interface (UPI), major Credit/Debit cards (Visa, Mastercard, RuPay), Net Banking, and verified electronic wallet providers. All payments are processed through PCI-DSS compliant secure gateways.
Retail orders are typically dispatched within 24 to 48 hours of order confirmation. Standard domestic shipping across major Indian cities takes approximately 3 to 7 business days. Delivery delays caused by courier logistics or weather conditions are beyond our immediate control, but our concierge team provides full tracking support.
Due to strict hygiene, cosmetic safety standards, and the personal nature of fine fragrance products, we do NOT accept returns or exchanges for opened, sprayed, or unsealed perfume bottles once delivered.
Exceptions: Returns or replacements are strictly limited to instances where the product arrives physically damaged, leaking, or defective. To claim a replacement:
Contract manufacturing begins with laboratory sample formulation. Bulk production will commence strictly after the client signs the official Master Sample Approval Form. Any request for formula modification post-approval will incur additional development fees and timeline extensions. Custom formulations engineered exclusively for a client remain protected under Non-Disclosure Agreements (NDAs).
Our standard contract manufacturing Minimum Order Quantity (MOQ) is 500 units per SKU. Commercial payment milestones are structured as follows:
In accordance with international cosmetic manufacturing standards, custom bulk liquid filling runs are subject to an industry-standard yield variance tolerance of +/- 5% on total finished units. Final billing will reflect the exact quantity of quality-inspected, filled units produced.
All bulk liquid compounding complies with IFRA (International Fragrance Association) safety limits and CDSCO Indian cosmetics standards. We issue batch-specific Gas Chromatography-Mass Spectrometry (GC-MS) reports and Safety Data Sheets (SDS) upon request.
Because private label production involves customized bottle molding, custom cap anodizing, and bespoke essential oil compounding:
Non-Cancellable Status: B2B manufacturing purchase orders CANNOT be canceled, modified, or refunded once advance payment is received and raw material/packaging procurement has commenced.
Limitation of Liability: To the maximum extent permitted by applicable Indian law, KbyV’s total cumulative liability for any claim, loss, damage, or breach arising out of retail sales or contract manufacturing agreements shall not exceed the net purchase amount paid by the customer for the specific order giving rise to the claim.
Force Majeure: Neither party shall be held liable for failure or delay in fulfilling performance obligations if such failure arises from acts of God, extreme natural disasters, global raw material supply blockades, government restrictions, industrial labor strikes, or unexpected customs embargoes beyond reasonable control.
